By reserving a yacht charter or utilizing our Service, you accept these Terms. Should you not agree to any section of these terms, you are not permitted to use the Service.
2. Service Overview
PublicCommonsOutreach offers a range of luxury yacht charter services, which include but are not limited to:
- Yacht rentals for the day
- Evening yacht tours
- Company retreats
- Exclusive gatherings
- Extended charters
We provide our services subject to their availability and prevailing weather conditions. We retain the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For booking a yacht charter, you will need to:
- Be at least 18 years of age
- Supply truthful and complete details
- Make a deposit payment as indicated in your booking confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is provided once your payment is received and we send you a written confirmation. We may deny service to any individual at our discretion.
3.3 Availability
Yacht charters are offered based on the availability of the vessel and suitable weather conditions. We shall endeavor to accommodate your requested dates and timings.
4. Payment Terms
4.1 Pricing
All price quotes are in € and they encompass all applicable taxes unless specified otherwise. Prices may change without any prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total charter fee due at the time of booking
- Final Payment: Must be completed 48 hours prior to the departure of the charter
- Incidental expenses (if any): Payable after the charter concludes
4.3 Methods of Payment
We accept a variety of payment methods, including major credit cards, bank wire transfers, and certified checks. We ensure your payments are processed securely through encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full reimbursement minus any processing charges
- Between 24-72 hours before departure: A refund of 50% of the total cost
- Less than 24 hours before departure: No return
5.2 Cancellations Due to Weather
If unsafe weather conditions are determined by our captain, we will propose to either:
- Reschedule the charter to another suitable date at no additional charge
- Refund the full amount if rescheduling proves to be impracticable
5.3 Mechanical Failures
In the scenario of a technical issue with the vessel allocated to you, we will strive to supply an appropriate replacement. If a substitute is unobtainable, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Regulations
All guests must:
- Adhere to instructions given by the crew
- Utilize safety equipment as instructed when necessary
- Disclose any medical conditions that could impact their security
- Stay within permitted areas on board the yacht
6.2 Prohibited Objects
Certain items are not allowed on the yacht:
- Containers made of glass
- Illegal materials
- Weapons or firearms
- Excessive amounts of drinks beyond reasonable limits
- Pets (unless given prior approval)
6.3 Behavior
All passengers are expected to behave respectfully. We reserve the right to end a charter prior to its scheduled conclusion, without issuing a refund, if a guest's conduct is threatening to safety or interferes with the enjoyment of others.
7. Liability and Insurance
7.1 Limitation of Our Liability
We limit our responsibility to the cost paid for the charter. We are not accountable for:
- Personal injuries that occur due to a guest’s carelessness
- The loss or damage of personal belongings
- Indirect, incidental or punitive losses
- Delays caused by the weather or issues outside of our control
7.2 Insurance
We maintain robust marine insurance that covers our fleet and operations. Clients are accountable for arranging their own travel and personal insurance.
7.3 Acknowledgment of Risk
By using our charter services, you acknowledge the inherent risks associated with maritime activities and assume responsibility for your own safety and welfare.
8. Alterations and Changes to Itineraries
We hold the right to alter itineraries, routes, or timetables due to weather, safety, or operational needs. We aim to provide a comparable alternative should such adjustments be necessary.
9. Force Majeure
We shall not be liable for any hold-ups, cancellations, or alterations that arise due to factors beyond our control, such as but not limited to:
- Extreme weather events
- Natural disasters
- Legal regulations
- Shut down of ports
- Technical malfunctions
10. Data Privacy and Security
Your private details are managed according to our Privacy Policy. By engaging with our services, you consent to the gathering and application of your data as explained in our Privacy Policy.
11. Copyright and Trademarks
Content found on our website, which includes but is not limited to text, graphics, logos, and photographs, is protected by intellectual property laws. Unauthorized copying, distribution, or creation of derivative works is prohibited without written permission from us.
12. Law and Jurisdiction
The governance of these Terms is under the jurisdiction of the laws in Germany. Any conflicts shall be adjudicated in the courts of Hamburg, Germany.
